Idaho Mercury Decision July 2021

In sum, the Court holds that the EPA violated its nondiscretionary duties under Section 303(c) of the CWA to promptly publish and promulgate a mercury water quality standard for Idaho. The Court rejects the EPA’s arguments to the contrary. Now that the EPA’s liability has been established, the Court will allow the parties to brief the issue of appropriate relief per the parties’ request in their briefs and at the hearing.
