Lakewood Wastewater Permit Comments
There are two essential items needed to issue an NPDES permit: information on the quality of the effluent and information on the quality of the receiving water. Starting with the second, DEQ’s fact sheet fails to set out all of the relevant facts and then fails to explain how the discharge relates to those facts. The fact sheet states that Mill Creek violates water quality standards for total arsenic and biological criteria. Fact Sheet at 5. The fact sheet dismisses the total arsenic violations as “not relevant anymore” on the basis the state no longer has total arsenic criteria. The fact sheet omits any reference to the fact that Mill Creek is water quality limited due to flow modification as well as habitat modification, as DEQ’s 2010 Integrated Report Database demonstrates.
