NWEA Opposes Puget Sound Nutrient General Permit
Under pressure from NWEA’s formal rulemaking petition and lawsuit in state court to control nutrient pollution from Puget Sound sewage treatment plants, the Washington Department of Ecology recently invited public comment on its idea to issue a blanket permit that would cover nutrient discharges from all or most plants. In its comments, NWEA explained to Ecology why its idea of a general permit (that would be an add-on to the individual permits that these facilities) is illegal.
Very simply: Washington Ecology’s Nutrient General Permit as Illegal. Ecology’s idea is an immediate fail because Ecology does not intend to use its proposed general permit to actually limit nutrient pollution to meet water quality standards, which is a basic test of legality under the Clean Water Act.
